The Federal Government will continue to rely on legal advice to defy opposition and Greens moves to make public how much money is being collected from Labor's mining tax.

The Senate on Wednesday will consider two motions calling on the government to provide revenue details to upper house estimates hearings next week.

Australian Greens leader Christine Milne says the taxation commissioner could reveal how much revenue was collected under the minerals resource rent tax during the September and December quarters.

"If not, we will be requiring that information," she told reporters in Canberra on Wednesday.

The Greens gave Labor its support for the tax.

Treasury has forecast the tax on the super profits of iron ore and coal miners to raise $2 billion this financial year.

But so far the big miners - Rio Tinto, Xstrata and BHP Billiton - don't appear to have paid any tax.

Senator Milne said the Greens have been advised the tax commissioner could reveal the mining tax receipts, which was contrary to the government's position.

Finance Minister Penny Wong insists that is not the government's advice and that it must comply with the privacy provisions of tax law.

"That's the law and we will comply with it," she told reporters.

"It's not in the political interest of anybody, nor in the interest of the country for governments to ignore what the law says."
